Sunset Receives FCC Approval for OptiNet Purchase
(Duffield, Virginia) – Last week the Federal Trade Commission Wireline Competition Bureau granted the application of Sunset Digital Communication’s for a transfer of control of certain assets of the OptiNet Division of the BVU Authority pursuant to Federal Communication Commission’s streamlined procedures for domestic section 214 transfer of control applications, 47 CFR § 63.03. According to the public notice of the FCC (attached), the Wireless Competition Bureau determined that the grant of these applications serves the public interest. This action by the FCC followed a January 4, 2018 action granting the International Authorization required for the closing of the OptiNet transaction. Both the domestic and the international notices by the FCC are attached.
“Last week, we cleared the final regulatory hurdle in the process for Sunset to close on the purchase of OptiNet,” said Sunset Digital Communications CEO and co-founder, Paul Elswick. “We’re now ready to close the transaction and start expanding broadband availability in Southwest Virginia,” he added.
Both company founders stated that the law firm, Eckhert Seamans Cherin & Mellott, LLC, had been instrumental in achieving approval from both the Virginia State Corporation Commission and the United States Federal Communication Commission.
The approval by the Federal Communication Commission follows the necessary approvals of the State Corporation Commission issued on October 25, 2017.
